By using https://penichecomms.ca, using Tools Studio, or working with Peniche Communications, you're agreeing to the terms below. We've tried to keep it readable — if anything's unclear, just ask.
Peniche Communications provides copywriting, brand strategy, and communications services, along with digital products sold through the shop. The specific scope, timeline, and price of any client project is agreed separately with each client before work begins — this page covers the general terms of using the site and shop, not individual project contracts.
Tools Studio (tools.penichecomms.ca) is our set of online tools for building documents, calendars, puzzles and websites, including Website Builder and Page Editor. These terms apply to it along with the sections above.
Content you may use. You agree to use our tools and services only with content you created or have the right to use. You will not upload, enter, copy, publish or reproduce copyrighted or otherwise protected material (text, images, logos, fonts, music, templates, brand assets or anything else) without the owner's permission or another legal right to use it. That includes material taken from other people's websites, documents or brands, and it applies both to what you put into the tools and to what you export.
Lawful use only. You will not use our tools or services to promote, run, support or advertise any illegal business or activity, or to create documents, sites or other materials for one. That includes fraud, scams and impersonation; illegal goods or services; hate, harassment, or content that exploits or endangers others; and anything that breaks the law where you or your customers are located. You will not use the tools to mislead people or to infringe anyone's privacy, trademark or other rights.
Other misuse. You will not use the tools to send spam or spread malware, scrape or overload the service, get around credits, passes or limits, or share your account.
What we may do. If we believe this policy has been broken, we may remove content, suspend or close your account, and refuse further service, with or without notice where the risk is serious. We may cooperate with authorities and rights holders when the law requires or permits it. Credits, passes and hosting payments may be forfeited where an account is closed for breaking this policy, to the extent the law allows. To report a copyright or other concern, email contact@penichecomms.ca.
You are responsible for your use. You are solely responsible for the content you create, upload, publish or export, for how you use the tools and their output, and for getting any permissions or licences you need. We don't review your content in advance and don't check it for legality or ownership.
No responsibility for user misuse. Peniche Communications and its subsidiaries (meaning any company owned or controlled by Peniche Communications), affiliates, owners, officers, employees and contractors are not responsible or liable for any misuse of the tools or services by users, for any content users create, upload, publish or export, or for any claims, losses or damages that arise from it, to the fullest extent the law allows. This does not limit anything that cannot legally be limited.
You cover the cost of your misuse. You agree to defend and compensate Peniche Communications and its subsidiaries, affiliates, owners, officers, employees and contractors against claims, losses and costs (including reasonable legal fees) that arise from your content, or from your breaking this policy or the law.
How to ask. Use our contact form: Request a refund or exchange. It opens with the details we need already listed (what you bought, when, the email on your account or order, and what you'd like). Wherever this section says "contact us", this is how.
Starter website packages. Exchanges and refunds are available within 48 hours of purchase, or until your onboarding information has been submitted — whichever comes first. Submitting your onboarding information signifies your consent for work to begin. This does not cover third-party costs already incurred on your behalf, such as domain registration or hosting fees. Request a refund.
Custom communications services & retainers. Custom engagements (strategy, crisis and change communications, ongoing retainers) are billed against time and deliverables already committed. Deposits are non-refundable once work has commenced. If you cancel a retainer mid-term, you're responsible for payment on all work completed up to the cancellation date; unearned fees for future periods are refunded on a prorated basis.
Digital products. All sales are final once a digital product has been delivered or downloaded. If a product is defective, corrupted, or doesn't match its description, contact us within 7 days of purchase and we'll provide a replacement or repaired file — we don't issue cash refunds for digital products outside of this scenario. Request a refund or replacement.
Tools Studio export credits. Each credit is used when you download an export, and used credits are not refundable. If you haven't used any credit from a pack, you may ask for a refund within 7 days of buying it. If an export fails, or the file you downloaded is corrupted or won't open, contact us within 7 days and we'll restore the credit or fix the file (an exchange, not a cash refund). Request a refund or exchange. Credits from the sign-up offer or any other promotion have no cash value and can't be refunded or exchanged for money.
Tools Studio monthly passes. Passes renew every month until you cancel on your Billing page. You can cancel at any time: cancelling stops the next charge, and you keep access until the end of the month you've paid for. We don't refund the current month or months already used. If you were charged in error or twice, contact us and we'll correct it. Request a refund or correction.
Website Builder and Hosting by Peniche Communications. Hosting is a one-time payment for 12 months. You may ask for a refund within 48 hours of paying, as long as we haven't started setting up your site. After that, hosting is not refundable because the set-up work has begun. This does not cover third-party costs already paid on your behalf, such as domain registration. Export credits used for Website Builder follow the same rules as other export credits above. Request a refund or exchange.
Page Editor credits. These follow the same rules as export credits: used credits are not refundable, unused credits may be refunded within 7 days of purchase, and a failed export gets its credits restored. Free monthly credits that come with hosting have no cash value and don't carry over. Request a refund or exchange.
Approved refunds are issued to your original payment method (through Hostinger's checkout for shop purchases, or Stripe for Tools Studio) and may take 5–10 business days to appear, depending on your financial institution. If you're outside the windows above but aren't satisfied with your purchase, send us a request (or email contact@penichecomms.ca) and we'll see what we can do, at our discretion.
For custom client projects (website copy, strategy, retainers, etc.), ownership of final approved deliverables transfers to the client upon full payment, unless otherwise agreed in writing. Drafts, unused concepts, and our internal process materials remain our property.
Everything on this site — copy, design, graphics, and the Peniche Communications name and branding — belongs to us and shouldn't be copied or reused without permission.
We work hard to get things right, but we don't guarantee specific business outcomes (traffic, sales, engagement, etc.) from any copy, strategy, or product we provide. To the extent permitted by law, we're not liable for indirect or consequential damages arising from use of our site or services (see also the Usage policy above and the limit on our liability under Tools Studio).
These terms are governed by the laws of Alberta, Canada.
We may update these terms as the site or our services change. The date at the top will reflect the most recent update. For Tools Studio we may also tell you by email or a notice in the app, and continuing to use it after a change means you accept the updated terms.
